Terms of Image Usage and Privacy Terms

In order to submit the photograph of your smartphone, please confirm that you read and agreed to all of the below.
- In this document “Artist” refers to Shinji Toya.
- You confirm you are aged 18 or over, or able to give consent.

- You confirm that you have full legal ownership of the image being submitted or you are legally permitted to give a licence to Artist to use the image in the ways specified below.
- You agree to give the Artist a non-exclusive, royalty-free copyright licence to use, reproduce, modify, make derivative works of, publish and communicate to the public the image you submitted for his art project: Lives of Your Smartphones and its related future projects, without any compensation to you or approval by you.

You understand where provided, your email will not be disclosed to the public and will be stored on the artist’s own storage devices and the server (i.e. at the point of writing this document, the server was provided by one.com where the security of the server access is provided with password protection and their SSL certificates). The email address may be used to contact you, should there be any need to ask you about the submitted image.

You understand the submitted image will be stored on the artist’s own storage devices and the third party server mentioned above (at one.com).

You understand where the submitted image contains any identifiable name or appearance of an individual, the part of the image showing such information will be erased or redacted (i.e. obscured) before the image will be published as a piece of artwork on the website (https://livesofyoursmartphones.net - the exact website address subject to change in the future). In such a case, the original image you submitted will be deleted from the server and all of the artist’s local devices, after the piece of artwork is published on the website (https://livesofyoursmartphones.net) or by 12 calendar months after the submission date, whichever comes earlier.

You understand the image and information you submitted may not be published or redacted at the Artist's discretion where he considers the decision is favourable for privacy purposes or preventing defamation.
